This document establishes the general terms and conditions applicable to the services offered by Opengea SCCL (CIF F70709969), under the commercial brand Intergrid. Acceptance of these terms is an essential condition for the contracting and use of the services provided.
1. Identification of the parts
The service provider is Opengea SCCL, with CIF F70709969 and registered office in Catalonia. The user is the natural or legal person who contracts any of the services offered through the Intergrid website or by direct contract.
2. Description of services
Intergrid offers digital services such as:
- Registration and management of domains
- Shared web hosting, VPS and dedicated servers
- Email and email marketing
- Creation of self-manageable websites
- E-commerce and crowdfunding systems
- Development and hosting of web applications
- Security services, backup copies and monitoring
3. General conditions of use
- The user commits to making responsible use of the services, avoiding any action that may affect the security, stability or legality of the system.
- The use of services for sending junk mail (spam), distribution of malware, illegal activities, or any action contrary to current legislation is prohibited.
- The contracted resources are personal and non-transferable, except by express agreement.
4. Registration, access and account management
To access the services, the user must register by providing truthful and up-to-date information. The user is responsible for safeguarding their credentials and for any activity carried out from their account.
5. Prices and payment conditions
- The prices of the services are available on the website or through a personalized quote.
- Payments are made in advance and can be monthly, quarterly or yearly.
- In case of non-payment, Intergrid may temporarily suspend or permanently cancel the service.
6. Duration and renewal
The services have the duration indicated at the time of contracting. Renewal may be automatic if the user does not communicate their desire to cancel at least 15 days in advance.
7. Service Level Agreement (SLA)
Intergrid offers a 99.9% monthly availability commitment for hosting services, except in cases of force majeure, scheduled maintenance, or incidents beyond their control.
8. Technical support
Intergrid provides technical support via email or ticket system. The usual response time is less than 24 business hours.
9. Intellectual Property and Contents
The user is the responsible party and owner of the hosted content. Intergrid does not exercise any rights over the content and will only access it for technical, legal, or security purposes.
10. Data Protection and Confidentiality
Intergrid complies with the General Data Protection Regulation (GDPR). The personal data collected is treated confidentially and will never be transferred to third parties without consent, except for legal obligation.
11. Backup copies
Intergrid performs regular backups to ensure data recovery, but the user is ultimately responsible for keeping their own copies if the service does not include specific backup guarantees.
12. Limitation of Liability
Intergrid is not responsible for damages resulting from improper use, unauthorized access, third party failures or unrelated technical incidents. Any direct liability will be limited to the cost of the service contracted during the affected period.
13. Termination of the contract
Intergrid may suspend or terminate the contract if the user breaches the terms, misuses the services, or fails to meet payment obligations. The user may terminate the contract by giving a minimum of 15 days' notice.
14. Modifications of the terms
Intergrid reserves the right to modify these conditions. Changes will be notified with a minimum of 15 natural days via email or notice on the website.
15. Legislation and jurisdiction
These conditions are governed by Catalan and Spanish legislation. In case of conflict, the parties will submit to the courts of Barcelona.
